Facilities Management
There is a growing trend towards the outsourcing of FM Services to specialist Service Providers, frequently including such services as building & grounds maintenance, property management, catering, cleaning, equipment maintenance and security.
FM Contracts are often complex arrangements requiring consideration not only of the performance requirements but of a range of other commercial issues such as employment law, pensions, employment and other regulatory matters.
Very often FM Contracts form part of a much wider commercial arrangement particularly in the context of projects procured under PFI/PPP and in such circumstances it is important to have a thorough understanding of such procurement processes no matter how far down the supply chain the FM Contractor may be.
Whether you are an FM service provider, a large plc or a public sector body you need legal advisers who have a sound commercial knowledge of the business drivers behind the transaction (from each party's perspective), the requisite legal skills to advise on the diverse legal issues that FM projects create and the experience to offer pragmatic and commercial solutions to keep a project moving to a successful conclusion.
The team at Silver Shemmings have experience of advising FM Contractors on a number of large and complex FM Contracts, including contracts for the provision of services to schools, hospitals, health centres and local authority accommodation.
In addition the team also has experience of advising on and conducting disputes that arise in respect of the provision of FM Services including multi party disputes arising within long term operational PFI/PPP contracts.
The work undertaken by Silver Shemmings includes:
- Negotiation of Hard and Soft FM contracts
- Co-operation /Interface Agreements
- Operational Variations
- Operational advise, e,g benchmarking and market testing
