Mediation
According to CEDR (Centre for Effective Dispute Resolution) the estimated cost of conflict to UK businesses exceeds £30bn a year.
But it is not only necessary to consider direct financial loss. Businesses should also consider the less visible costs such as adverse publicity, damage to reputation, loss of customers, low morale and missed opportunities.
For some time the Courts have been actively encouraging the use of mediation and a party can incur adverse cost consequences if he or she chooses to ignore requests to mediate. Mediation is not always suitable but in our experience insurmountable obstacles can be overcome when the parties are willing to give mediation a go.
There are no hard and fast rules in mediation and a number of different styles are adopted by Mediators in an attempt to obtain settlement. What is important however is that clients select lawyers with practical experience of mediation.
